The short version. The prices on this site are estimates, not a quote. A written quote is the thing that counts. You pay 25% to start and the rest over the following few weeks. Once it is paid, the website is yours to keep and do what you like with.

Nothing on this page takes away your rights under Australian Consumer Law.

Who you are dealing with

ForgedWeb is a sole operator web design business on the Sunshine Coast, Queensland, run by Tye. In these terms, "I" and "me" mean ForgedWeb, and "you" means the person or business engaging it.

Using this website

You are welcome to read this site, and to show it to anyone. Please do not copy its code or design wholesale to pass off as your own work, attempt to break or disrupt it, or use it to send unsolicited commercial messages.

The site is provided as it is. I keep the information accurate, but I do not guarantee it is complete or current at any given moment.

Prices on this site are estimates

The figures published here, and any total produced by the estimate tool, are indicative ranges to help you work out whether this is worth a conversation. They are not an offer and they are not a quote. The real number depends on what your business actually needs, and I will tell you what it is before you commit to anything.

Quotes

A quote is what I send you in writing, covering the specific work, the price and what is included. That written quote, once you accept it, is the agreement between us, and it overrides anything on this page or elsewhere on the site that conflicts with it.

Quotes are open for 30 days unless the quote says otherwise.

Paying

What I need from you

A website needs its content. To build yours I need your text, photos, logo, prices and contact details, and answers when I ask questions. You confirm that you have the right to use anything you send me, particularly photographs and logos.

If materials or answers do not arrive, the build stops until they do. That is not a penalty, it is simply that the work cannot continue without them.

The finished site is yours

When the final payment clears, the website I have built for you belongs to you outright. There is no licence fee, and nothing that stops you taking it elsewhere or having someone else work on it.

Hosting and upkeep

Keeping the site online is a separate, ongoing service: $40 a month, or $60 a month if you have the admin back end. That covers hosting, backups and keeping the site updated.

It is not a licence fee and it does not buy your ownership back from you. The site is yours either way — if you stop the monthly, you can take the files and host them wherever you like. There is no lock-in and no exit fee. Month to month, cancel whenever.

Two sensible exceptions. Third-party components used in the build — typefaces, stock images, code libraries — stay under their own licences, and I will tell you what those are. And I may show the finished site in my portfolio unless you ask me not to.

Things in your name, not mine

Domain names, hosting accounts and any paid third-party services are registered to you and paid by you. You keep control of them. I can set them up for you, but I do not hold them hostage and I do not take a margin on them.

If the work is cancelled

Either of us can stop the work. If that happens, you pay for what has been done up to that point and nothing more. If that is less than you have already paid, I refund the difference. If it is more, I invoice the difference.

Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees. Where the law allows a supplier to limit its liability, mine is limited as set out below.

Liability

Except for the consumer guarantees above, and to the extent the law permits, my liability for any claim connected with the work is limited to re-performing the work or refunding what you paid for it, whichever I choose. I am not liable for indirect or consequential loss, including lost profits or lost business.

Which law applies

These terms are governed by the law of Queensland, Australia, and the courts of Queensland deal with any dispute.

Changes

I may update these terms. The version that applies to your job is the one in force when you accepted your quote.
